Not sure if this has been noticed as a feature request:

There has to be a way to detect Tablet Mode. Only then it will be possible. This page has some details: https://msdn.microsoft.com/en-us/library/windows/hardware/dn917883(v=vs.85).aspx

Well just because its there, doesn't mean we know where it is :P It has to be there, if windows knows when a tablet is in tablet mode (IE uses full-screen start menu when its un-docked)
Like many things in windows its just sitting there undocumented until someone discovers it, and a way to use it
Its a matter of checking that flag with every press of the start button...

Actually no .. it should depend on the tablet-mode toggle. At least I don't see why pressing the Start button would be the trigger.

The thing is classic shell doesn't have core access to the program that writes that change, so it cant say "notify me when you change this setting" but rather just check to see if the setting has changed

That means it would be better to check when the button is pressed, rather than on an interval. which would eat cpu, and cause unnecessary disk reads

It could be done either way (and it could actually be done with a periodic check outside of classic shell (by sending a command to kill classic shell, or launch it respectively)

Thanks for the insight. From a user's perspective I wouldn't like to see the CS Start Icon in Tablet mode until I use the button itself (and vice versa). Also the overall appearance of the menu would change the moment I use it .. doesn't seem the right way to go for me.

Starting with Classic Shell 4.2.5, there is a new setting for the Win key and Start button click to open the Windows Menu when in Tablet mode but Classic Start Menu otherwise.
